LIMITED WARRANTY

Express Limited Warranty.  

Lithium Products, LLC d/b/a Lithium Pros (“Lithium Pros”) warrants that this product will be free from defects in materials and workmanship under normal use and service, subject to the express terms, remedies, exclusions, conditions, limitations, and disclaimers set forth below.  

Warranty Term and Remedies.  

C series and T series

For all Lithium Pros C series and T series (such as models C680, C925, and others, and T680-16, T1600, and others) the limited warranty provided hereunder shall extend for two (2) years from the date of the product’s purchase. Commercial applications are excluded from this term and are subject to a separate warranty policy. Should any covered defect in materials or workmanship be discovered during the first six (6) months following the product’s purchase, Lithium Pros will repair or replace the product free of charge subject to the exclusions below. Should any covered defect in materials or workmanship be discovered during the remaining eighteen (18) months following the product’s purchase, you may obtain a replacement battery at a reduced price.  The reduced price on a Pro-Rata basis starting at the end of the six (6) month free replacement period.  The price will be the number of months in service multiplied by the cost per month.  The cost per month is the Suggested Retail Price divided by the Pro-Rata period, in this case 18 months.   For example, if a battery costs $1,000 MSRP and was in service for 7 months (1 month beyond the 6 month free replacement period), a replacement could be purchased under this warranty for $55.55.  If this same battery was in service for 23 months, a replacement could be purchased for $944.35.  This is the monthly warranty cost of $55.55 ($1,000 divided by 18 months) multiplied by the number of months in service. Obtaining a free replacement battery during the six (6) month free replacement period does not extend the term of this warranty.

L series and P series

For all Lithium Pros L series and P series batteries (such as models L1600A, L3400, and others, P3426, P1625, and others) and all Lithium Pros battery chargers and accessories, the limited warranty provided hereunder shall extend for two (2) years from the date of the product’s purchase. Commercial applications are excluded from this term and are subject to a separate warranty policy. Should any covered defect in materials or workmanship be discovered during the limited warranty period, Lithium Pros will repair or replace the product free of charge subject to the exclusions below. Obtaining a free replacement battery does not extend the term of this warranty.

M series

For all Lithium Pros M series batteries (such as models M3110, M3140-36, and others), the limited warranty provided hereunder shall extend for seven (7) years from the date of the product’s purchase in consumer applications on a Pro-Rata basis. This warranty includes a four (4) year free replacement period. Commercial applications are excluded from this term and are subject to a separate warranty policy. Should any covered defect in materials or workmanship be discovered during the 84 months following the product’s purchase, you may obtain a replacement battery at a reduced price. The reduced price is on a Pro-Rata basis starting from the date of purchase.  The price will be the number of months in service multiplied by the warranty cost per month.  The cost per month is the Suggested Retail Price divided by the Pro-Rata period, in this case 84 months.   For example, if a battery costs $1,000 MSRP and was in service for 49 months (1 month beyond the four (4) year free replacement period), a replacement could be purchased under this warranty for $583.34.  If this same battery were in service for 83 months, a replacement could be purchased for $988.10.  In these examples, the monthly warranty cost is $11.90 per month ($1,000 divided by 84 months).  Obtaining a free replacement battery during the four (4) year free replacement period does not extend the term of this warranty.

TM series

For all Lithium Pros TM series batteries (such as models TM3190, TM2450, and others), the limited warranty provided hereunder shall extend for seven (5) years from the date of the product’s purchase in consumer applications on a Pro-Rata basis. This warranty includes a three (3) year free replacement period. Commercial applications are excluded from this term and are subject to a separate warranty policy. Should any covered defect in materials or workmanship be discovered during the 60 months following the product’s purchase, you may obtain a replacement battery at a reduced price.  The reduced price is on a Pro-Rata basis starting from the date of purchase.  The price will be the number of months in service multiplied by the warranty cost per month.  The cost per month is the Suggested Retail Price divided by the Pro-Rata period, in this case 60 months.   For example, if a battery costs $1,000 MSRP and was in service for 37 months (1 month beyond the three (3) year free replacement period), a replacement could be purchased under this warranty for $616.67.  If this same battery were in service for 59 months, a replacement could be purchased for $983.33.  In these examples, the monthly warranty cost is $16.67 per month ($1,000 divided by 60 months).  Obtaining a free replacement battery during the three (3) year free replacement period does not extend the term of this warranty.

Exclusions.  

This limited warranty shall not apply to damage to or failure of a product that results from: (i) any negligence other than by Lithium Pros; (ii) accident (including, but not limited to, damage during shipment and natural disasters); (iii) other circumstances beyond Lithium Pros’ control (including, but not limited to, normal capacity loss or increased resistance due to product aging); (iv) improper installation, operation (including, but not limited to, abnormal or non-consumer use or use in an environment outside the recommended temperature range), maintenance, or storage (including, but not limited to, storage in an overly discharged state); or (v) any other damage directly or indirectly caused by the product’s owner, other third parties, or other products (including, but not limited to, misuse, abuse, overcharging, over-discharging, exceeding of the product’s limitations set forth in the product’s specification sheet or label, neglect, physical damages caused by accidents or crashes, alterations, or connection to poorly-grounded battery chargers).  This limited warranty shall also not apply to defects or non-conformities due to the manufacturing process discovered after the expiration of the applicable warranty period.  This warranty does not extend to any damage caused by affixing any parts or equipment not purchased from Lithium Pros to the product and no warranties, either express or implied, are made with respect to equipment or products not produced by Lithium Pros.  If the product is relocated outside of the continental United States during the applicable warranty period, the product’s owner will be responsible for any additional charges (including, but not limited to, shipping and other related charges and expenses) incurred during the warranty process as a result of such relocation.

Conditions.

In order to qualify for this limited warranty, all products must be registered with Lithium Pros within sixty (60) days of purchase.  Any battery not registered within Lithium Pros within this period shall not be eligible for warranty coverage.  Notice of any warranty claim must be provided to Lithium Pros within thirty (30) days of discovery in order to be eligible for warranty coverage.  All warranties shall terminate at the end of the applicable warranty period. All warranty claims require a copy of the original receipt and must be made directly to Lithium Pros.  All products for which a warranty claim is being made must be returned prepaid direct to Lithium Pros.  Warranty claims cannot be made or facilitated through Lithium Pros’ distributors or retailers and a warranty product cannot be returned to the distributor or retailer from which it was purchased.   Within the applicable warranty period, and unless the warranty terms for a particular product provide otherwise, Lithium Pros will repair or replace, at its sole discretion, an eligible product that proves to Lithium Pros’ reasonable satisfaction and at Lithium Pros’ sole discretion to have eligible defects in material or workmanship.  In making repairs, Lithium Pros may use, at its sole discretion, functionally equivalent or reconditioned/refurbished/pre-owned accessories or parts.  The remedies provided in this limited warranty shall be Lithium Pros’ sole warranty obligations and the product owner’s exclusive remedies for any breach of warranty.

This limited warranty is transferable; however, no transfer or sale of the product or this limited warranty shall extend the applicable warranty period or otherwise alter any of the express terms, remedies, exclusions, conditions, limitations, and disclaimers set forth herein.  

Limitations and Disclaimers.  

LITHIUM PROS MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THIS PRODUCT OTHER THAN THOSE EXPRESSLY STATED IN THIS LIMITED WARRANTY.  THE FOREGOING LIMITED WARRANTIES ARE EXCLUSIVE AND IN LIEU OF ALL OTHER EXPRESS AND IMPLIED WARRANTIES WHATSOEVER.  LITHIUM PROS SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  TO THE FULLEST EXTENT THAT DAMAGES MAY BE DISCLAIMED BY LAW, LITHIUM PROS SHALL NOT BE LIABLE, WHETHER IN CONTRACT OR TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), FOR ANY DAMAGES IN EXCESS OF THE PRODUCT’S PURCHASE PRICE OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY LOSS OF REVENUE, PROFITS, BUSINESS, INFORMATION, DATA, OR ANY OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE PRODUCT.
